
Track Speed Development — Membership Agreement
Track Speed Development Pty Ltd (ABN 77 647 817 516) ("TSD", "we", "us", "our")
These Terms and Conditions form a binding agreement between TSD and the person who subscribes to a TSD membership ("you", "your"). By ticking "I agree to the Terms" at checkout and clicking Subscribe, you accept this Agreement. If the athlete is under 18, the subscribing parent or guardian accepts this Agreement on the athlete's behalf and is responsible for all payments.

All amounts are in Australian dollars. Your membership includes track programming, strength & conditioning programming, and rehabilitation programming as part of in-person sprint coaching.
2. Commencement
Your membership commences when your subscription is accepted at checkout. Access to coaching begins once your first fortnightly payment has been received.
3. Important Risk Warning
Participation in sprint training and associated conditioning carries inherent risks of serious injury or death. Risks include, but are not limited to, collisions, over-exertion, equipment failure and environmental conditions. By accepting this Agreement, you acknowledge these risks and voluntarily participate at your own risk.
4. Our Obligations
In consideration of your fees, we agree to: provide the services with due care and skill; maintain the premises and equipment in a safe condition so far as is reasonably practicable; and use best endeavours to deliver sessions during published training times.
5. Your Obligations & Rules of Conduct
You agree to: comply with these Terms, posted rules and reasonable directions of our coaches; check in or sign in each visit as directed; wear suitable athletic clothing and footwear; not attend under the influence of drugs or alcohol; keep belongings safe (we accept no responsibility for lost or stolen items); treat staff, members and equipment with respect; and stop training and notify us immediately if you feel unwell or sustain an injury.
6. Member Health Warranty
You warrant that you (or the athlete you enrol) are medically and physically fit to participate and have no condition that could be aggravated by participation. Medical clearance must be provided if requested.
7. Bookings
Certain sessions require advance booking via our website or by contacting us. Booked sessions may be cancelled up to 12 hours prior without penalty. Late cancellations or no-shows may incur a $20 fee.
8. Fees & Payment
8.1 Direct debit. Fees are collected automatically each fortnight from your nominated bank account (BECS direct debit) or card via our payment provider, Stripe. By subscribing you authorise these recurring debits for your plan's minimum term.
8.2 End of term. Your subscription ends automatically after the final scheduled payment of your plan (23 payments for Season; 6 payments for 3-Month). Continuing beyond your term requires a new sign-up.
8.3 Failed payments. If a debit fails, Stripe will automatically retry and notify you. Your membership may be suspended while payments remain outstanding, and a $15 administration fee may apply to repeated failures.
8.4 Price changes. Fees are fixed for your minimum term. We may adjust fees for new terms with 30 days' written notice.
9. Cooling-Off Period
You may cancel within 48 hours of subscribing by written notice to admin@trackspeeddev.com.au. Any sessions already attended will be charged pro-rata; any balance paid is refunded.
10. Suspension / Holds
You may suspend your membership for medical or travel reasons for up to 4 weeks per 12-month cycle. Requests must be made in writing at least 7 days in advance. Suspension extends your end date; debits are paused for the suspension period.
11. Termination
11.1 Early cancellation by member. Provide written notice and pay an early termination fee equal to 4 weeks of your current weekly rate, or the balance remaining on your minimum term, whichever is less. Remaining debits are then cancelled.
11.2 Medical cancellation. With supporting medical evidence, you may cancel without penalty.
11.3 Breach or non-payment. We may suspend or cancel your membership for serious breach of these Terms or continued non-payment.
11.4 Provider relocation or cessation. If we permanently close or relocate more than 15 km, you may cancel without fee and any amounts paid for undelivered weeks will be refunded.
12. Australian Consumer Law & Limitation of Liability
Nothing in these Terms excludes any consumer guarantees under the Competition and Consumer Act 2010 (Cth). To the maximum extent permitted by law, our liability for breach of such guarantees is limited to resupplying the services or refunding the fees paid. Except for liability that cannot be excluded, TSD and its personnel are not liable for any indirect or consequential loss, or for personal injury, illness or death resulting from your participation, except to the extent caused by our gross negligence.
13. Privacy
We collect personal information (including information collected at checkout by our payment provider) to manage your membership and deliver services. Our Privacy Policy is available on request and explains how we store, use and disclose your data and how you may access or correct it.
14. Dispute Resolution
Please raise concerns in writing to admin@trackspeeddev.com.au. We will endeavour to resolve issues within 14 days. If unresolved, either party may seek mediation before commencing court proceedings (unless urgent injunctive relief is required).
15. General
a) Entire agreement — this document supersedes all prior representations. b) Variation — must be in writing (save for fee changes under clause 8.4). c) Severability — invalid provisions are severed without affecting the remainder. d) Assignment — memberships are personal and not transferable without our consent. e) Governing law — New South Wales, Australia. f) Electronic acceptance — acceptance by electronic means (including ticking "I agree" at checkout) is binding.
Waiver of Liability & Release
I acknowledge the inherent risks outlined in clause 3 and agree, to the extent permitted by law, to release and indemnify Track Speed Development Pty Ltd, its directors, employees and contractors from any liability for injury, loss or damage incurred whilst participating in the services, except where caused by their reckless conduct. Where the athlete is under 18, this release is given by the parent or guardian who accepts this Agreement.
